Terms of Use

Last updated: 2026-09-24

These terms cover the iOS app FishCap (bundle ID com.fishcap.app, Apple App ID 6812298193). By downloading, installing or using FishCap you accept them. If you do not accept them, please do not use the app.

1. What the app does

FishCap is a fishing log: photograph and keep your catches, cut the fish out of the background, record species and measurements, spots and weather, review everything in a calendar and stats, and optionally use cloud AI to identify a species.

2. Accounts and identity

FishCap has no accounts and no in-app login. We never ask you to register and we do not collect an email address or any third-party account. Your identity is simply the Apple ID on your device: purchases are billed through it and your records sync through your own iCloud. For the same reason we cannot recover, migrate or hold your data for you.

3. Free use and the free allowance

Fair use

Subscribers' AI identifications are not sold in bundles, but they are subject to reasonable-use limits to prevent abuse. The current limits are 60 identifications per hour and 300 per day per device (the day resets at 00:00 UTC), plus a short-term rate limit against bursts of requests. Normal fishing use stays far below them. When a limit is reached, identification is temporarily unavailable and comes back on its own; logging and saving catches are not affected. We may adjust these limits to prevent abuse or protect the service.

4. Subscriptions

5. What AI identification is, and is not

An identification result is a machine-generated suggestion. It is not a determination, professional advice, or any kind of warranty. The model can return a wrong or incomplete species, name or description. Do not rely on it to decide whether a fish is safe to eat, venomous or spined, protected, or legal to keep. Complying with local law — licenses, size and bag limits, closed seasons, release requirements — is entirely your responsibility.

6. Your content

The photos, text and records you create in FishCap remain yours. Using the app gives us no ownership of them. To identify a photo you take or choose in the app, you grant us a limited license, for that processing only, to transmit that one photo to our identification proxy and its upstream model provider. Beyond that we do not use, publish or sell your content, and we do not train models on it.

7. Acceptable use

8. Third-party services

FishCap relies on Apple (App Store, In-App Purchase, iCloud, WeatherKit, App Attest), Cloudflare (which hosts our identification proxy), Google (the Gemini model that processes identification requests), and RevenueCat (which processes subscription receipts). Their own terms and privacy policies apply to those parts. Weather data is provided by Apple Weather.

9. Availability and changes

We may update, change or discontinue parts of the app, including the cloud identification service. Logging is designed to work fully offline; if cloud identification were to be retired permanently we would say so in the app and handle any active subscriptions under Apple's rules.

10. Disclaimers and limitation of liability

The app is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that identifications are correct, that the service is uninterrupted, or that no data is ever lost — please keep your own backups of photos that matter. To the maximum extent permitted by law we are not liable for indirect, incidental, special or consequential damages, and our total liability to you is limited to the amount you actually paid for the app in the 12 months before the claim.

Fishing carries its own risks. You are responsible for your own safety, equipment and conduct.

11. Termination

You can stop using the app at any time by deleting it. We may terminate your access to the cloud services if you seriously or repeatedly breach these terms. Deleting the app does not cancel a subscription — cancel it in iOS Settings as described in section 4.

12. Changes to these terms

We may revise these terms. Material changes update the "Last updated" date at the top of this page and, where appropriate, are surfaced in the app. Continuing to use FishCap after a change means you accept the revised terms.

13. Governing law

These terms are governed by the laws of the developer's jurisdiction, without regard to its conflict-of-law rules. Where mandatory consumer protection law in your country gives you stronger rights, that law prevails.
